Terms of Use

These Terms of Use ("Terms") govern your use of aleksformesa.com and any forms, pages, or communications operated by Aleks Vranicic for Mesa ("the Committee," "we," "our," "us"). By using the site or submitting any form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old to submit any form on this site or to provide your mobile phone number or email address to us.

2. Accurate Information

You agree to provide accurate, current, and complete information when submitting any form. You agree to update your information if it changes.

3. Permitted Use

This site is provided for informational purposes about the Aleks Vranicic for Mesa City Council campaign and to allow visitors to opt in to campaign communications. You agree not to:

  • Submit false, misleading, or fraudulent information
  • Use the site or its forms in any unlawful manner or for any unlawful purpose
  • Interfere with or disrupt the operation of the site
  • Use automated tools, scripts, or bots to submit forms, scrape content, or access the site
  • Impersonate any person or misrepresent your affiliation with any person or organization
  • Use the site to harass, threaten, or harm any person

4. Intellectual Property

All content on this site, including text, images, video, graphics, and design, is owned by Aleks for Mesa or its licensors and is protected by copyright and other intellectual property laws. You may share publicly posted campaign content with attribution to "Aleks for Mesa." You may not reproduce, modify, or redistribute the content for commercial purposes without our written permission.

5. Third-Party Services

This site uses third-party services for forms (GoHighLevel), text messaging (Twilio), email (Mailgun), and advertising measurement (Meta Platforms). Your use of those services is also subject to their own terms and privacy policies.

5A. SMS Program Description and Messaging Use Cases

Aleks for Mesa operates an SMS (text messaging) program through which subscribers who have explicitly opted in receive text messages from the campaign. The SMS program is used for the following messaging use cases:

Voting reminders: Notifications about when early voting opens, ballot return deadlines, election day timing, and polling hours.

Polling location information: Links and instructions to help subscribers locate their assigned polling place or ballot drop-off location.

Election information: Information about the Mesa City Council election, voter registration deadlines, and ballot information.

Campaign updates: Occasional updates from the Aleks for Mesa campaign, including announcements about candidate events, town halls, and campaign milestones.

Confirmation messages: Welcome messages confirming opt-in, and reply confirmations when subscribers respond.

Message frequency varies. Subscribers can expect approximately 3 to 9 messages during a 60 to 90 day period leading up to and including election day. Subscribers will not receive transactional, financial, or product-related SMS messages from us.

5B. SMS Opt-Out Instructions

You may opt out of receiving SMS messages from Aleks for Mesa at any time. To opt out, reply with any of the following keywords to any text message you receive from us:

STOP

UNSUBSCRIBE

CANCEL

END

QUIT

Once you reply with any opt-out keyword (such as Text STOP), you will receive a final confirmation message acknowledging your opt-out, and you will not receive any further SMS messages from Aleks for Mesa. Opt-outs are processed immediately. To opt back in at any time, reply START or text the keyword "JOIN" to the same number.

5C. Message and Data Rates Disclosure

Message and data rates may apply to any SMS messages you send to or receive from Aleks for Mesa, depending on your mobile carrier's rate plan and any text messaging or data plan you have subscribed to. Aleks for Mesa is not responsible for any charges incurred by you as a result of receiving SMS messages from us. Standard mobile carrier message and data rates apply per your individual cellular service plan. Contact your mobile carrier for specific information about your rate plan and any associated SMS or data fees. Message frequency may vary.

5D. Privacy Policy Reference

Information collected through the SMS opt-in program, including your mobile phone number and any related data, is handled in accordance with our Privacy Policy. Please review our Privacy Policy for detailed information about how we collect, use, store, and protect your personal information, including the mobile phone numbers you provide. Our Privacy Policy also includes important information about your rights, including your right to access, correct, or delete the information we hold about you. By opting in to our SMS program, you acknowledge that you have reviewed our Privacy Policy and agree to the data practices described therein.

Section 5E — Carrier Liability Disclaimer

Your wireless carrier is not liable for delayed, undelivered, or misdelivered SMS messages. Aleks for Mesa is not responsible for any issues, errors, or failures in SMS message delivery caused by your mobile carrier, your device, your network connection, your device settings, your data plan limitations, or any other circumstances outside our reasonable control. SMS messages may be delayed or undelivered due to network conditions, carrier outages, device settings, signal coverage, or other factors. Mobile carriers — including but not limited to T-Mobile, AT&T, Verizon, Sprint, US Cellular, Boost Mobile, Cricket Wireless, and any other wireless carrier — are not responsible for any text message delivery delays or failures, nor for any content, omissions, or inaccuracies in messages sent by Aleks for Mesa. By opting in to receive SMS messages, you acknowledge that mobile carriers are not party to our SMS program and disclaim any liability relating to it.

The site may contain links to other websites. We are not responsible for the content, accuracy, or privacy practices of any linked site.

7. No Endorsement

References on this site to any organization, business, or individual do not imply that party's endorsement of the Committee unless explicitly stated.

8. Disclaimers

The site is provided on an "as is" and "as available" basis. We make no warranties, express or implied, that the site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Information on the site is provided for campaign communication purposes only and is not professional, legal, financial, or voting advice. Always verify polling place, ballot, and election information with official sources, including the Maricopa County Recorder and the Arizona Secretary of State.

9. Limitation of Liability

To the maximum extent permitted by law, Aleks for Mesa, its officers, employees, contractors, and volunteers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site, including but not limited to loss of data, loss of opportunity, or any communications failures of third-party SMS or email providers.

10. Indemnification

You agree to indemnify and hold harmless Aleks for Mesa and its representatives from any claim or demand arising from your violation of these Terms or your misuse of the site.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or your use of the site will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. The most current version is always posted at this URL with the effective date shown above. Your continued use of the site after changes are posted means you accept the updated Terms.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
